Pathway International Acceptable Use Policy (AUP)

Introduction
Pathway International's Usage Policy is designed to protect Pathway International,
its venders, contractors, affiliates, customers and others from illegal, malicious,
damaging and inappropriate behavior by users of Pathway International's services.
All users of Pathway International's services are subject to the Usage Policy.
This Acceptable Use Policy encourages the responsible use of Pathway
International's services and delineates the relatively narrow range of uses of
Pathway International services that are contrary to Pathway International's mission,
generally because such uses either pose an unacceptable risk to the stability,
integrity, or quality of Pathway International's systems or the systems of its vendors,
or harm (or threaten to harm) the rights and interests of third parties. This
Acceptable Use Policy supplements your Service Agreement with us. Uses of the
Pathway International services described below are prohibited.
Usage Policy
AUP
Scope and Application of Policy
Pathway International maintains this Acceptable Use Policy ("AUP") to provide users
of its Services (as such term is defined in the Terms of Service for purposes of this
AUP, the term "Services" shall also be deemed to include Pathway International's
various systems and network) with a clear statement of rules and use restrictions
that apply to the use of Pathway International's Services.
This AUP forms an integral part of the Terms of Service that govern your use of
Pathway International's Services. Your compliance with and cooperation in Pathway
International's enforcement of this AUP is an express condition to your continuing
contractual rights to use Pathway International's Services. This AUP also applies to
your employees, agents, contractors and end users. The evolving nature of the
Internet and on-line commerce makes it necessary for Pathway International to
reserve the right to make changes to this AUP at any time. You agree that any
changes will be effective when posted on-line at our website and that your continued
use of Pathway International's Services will constitute your acceptance of any
changes or additions to this AUP. You may determine the date of posting at the
Effective Date section of this AUP.
This AUP is not intended to address all possible unacceptable uses of Pathway
International's Services. As a result, Pathway International reserves complete
discretion to determine what constitutes an unacceptable use of its Services and
reserves the right to suspend or terminate your Services, or take such other action
as Pathway International deems appropriate in its sole discretion.
Prohibited Uses
I. You agree to comply with all applicable local, state, national and international laws
and regulations regarding use of all services delivered by Pathway Internationals.
The following are prohibited uses of our services:
Transmission, distribution, uploading, posting or storage of any material in violation
of any applicable law or regulation is prohibited. This includes, without limitation,
material protected by copyright, trademark, trade secret or other intellectual property
right used without proper authorization, and material that is obscene, defamatory,
libelous, unlawful, harassing, abusive, threatening, harmful, vulgar, constitutes an
illegal threat, violates export control laws, hate propaganda, fraudulent material or
fraudulent activity, invasive of privacy or publicity rights, profane, indecent or
otherwise objectionable material of any kind or nature. You may not transmit,
distribute, or store material that contains a virus, "Trojan Horse," corrupted data, or
any software or information to promote or utilize software or any of Pathway
International services to deliver unsolicited e-mail. You further agree not to transmit
any material that encourages conduct that could constitute a criminal offense, gives
rise to civil liability or otherwise violates any applicable local, state, national or
international law or regulation.
You may not use Pathway International's Services to disseminate or display images
or other content that constitutes child pornography under United States laws.
Pathway International applies a zero tolerance policy to the enforcement of this
prohibition. Pathway International takes an active role in cooperating with law
enforcement officials in their efforts to prosecute violations of statutes that prohibit
the dissemination of child pornography. Pathway International reports the use of its
Services to disseminate or display child pornography as required by law. You will not
be notified that Pathway International may be cooperating with law enforcement or
that Pathway International has reported the use of its Services in this manner.
Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of
Unsolicited Bulk Email through Pathway International's servers is prohibited.
Likewise, the sending of UBE from another service provider advertising a Website,
email address or utilizing any resource hosted on Pathway International's servers, is
prohibited. Pathway International accounts or services may not be used to solicit
customers from, or collect replies to, messages sent from another Internet Service
Provider where those messages violate this Policy or that of the other provider.
Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list
without the express and verifiable permission of the email address owner is
prohibited. All mailing lists run by Pathway International customers must be Closed-
loop ("Confirmed Opt-in"). The subscription confirmation message received from
each address owner must be kept on file for the duration of the existence of the
mailing list. Purchasing lists of email addresses from 3rd parties for mailing to or
from any Pathway International hosted domain, or referencing any Pathway
International account, is prohibited. To avoid action under our AUP, please familiarize
yourself with the CAN-SPAM Act by following this link:

Advertising, transmitting, or otherwise making available or using any software,
program, product, or service that is designed to violate this AUP or the AUP of any
other Internet Service Provider, which includes, but is not limited to, the facilitation of
the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-
bombing, and denial of service attacks.
Forwarding Internet users to any Website that, if such Website were provided by
Pathway International, would violate the provisions of this Acceptable Use Policy.
Using the Private Registration service to provide anonymity to activities which are
unlawful, fraudulent, or violate the intellectual property rights of a third party.
Using the DNS Manager service, or knowingly or recklessly permitting others to use
the DNS Manager Services: (a) for any unlawful, invasive, infringing, defamatory, or
fraudulent purpose; (b) to alter, steal, corrupt, disable, destroy, trespass or violate
any security or encryption of any computer file, database or network; (c) so as to
materially interfere with the use of Pathway International's network by other
customers or authorized users; (d) in a manner that is inconsistent with Pathway
International routing policies, provided you have notice of such policies or such
policies are publicly available on Pathway International Website; (e) in violation of
the applicable acceptable use policies of Pathway International's backbone
providers, provided you have notice of such policies or such policies are publicly
available on such backbone providers' Websites; (f) to alter, tamper with, adjust,
repair or circumvent any aspect of the DNS Manager Service provided by Pathway
International; or (g) in a manner which, in Pathway International opinion, is
inconsistent with the generally accepted rules of Internet etiquette and conduct.
Unauthorized attempts by a user to gain access to any account or computer
resource not belonging to that user (e.g., "cracking").
Obtaining or attempting to obtain service by any means or device with intent to avoid
payment.
Engaging in any activities that do or are designed to harass, or that will cause a
denial-of-service (e.g., synchronized number sequence attacks) to any other user
whether on the Pathway International network or on another provider's network.
Using Pathway International's services in a manner that interferes with the use or
enjoyment of the Pathway International network or other services by other
customers or authorized users. This shall include excessive use of services which
impair the fair use of other Pathway International customers.
Holding of Pathway International (including its affiliates, partners and third parties) or
their employees or shareholders up to public scorn, ridicule, or defamation.
Impersonating any person or entity, including, but not limited to, a Pathway
International official, or falsely stating or otherwise misrepresenting your affiliation
with a person or entity.
II. You acknowledge and agree that it is a violation of this AUP for your services to
cause an interruption or degradation of, interference with, or disproportionate burden
on the operations of Pathway International's systems or the services of other
customers, regardless of whether such interruption, degradation, interference or
burden is the result of your actions or those of a third party over which you have no
control.
III. You are solely responsible for the content you furnish to Pathway International in
connection with your Website or other services we provide to you, or make available
to others through use of our services. Pathway International cannot and does not
design (except where you are receiving our Design Services), review or screen
content you provide to us for inclusion in your Website (or that you use, provide or
make available in connection any services we provide to you) and does not assume
any obligation to monitor such content. However, you agree that we may review your
Website or any other content in responding to a third party complaint or for any other
reason.
IV. You may access and use our services for lawful purposes only and you are solely
responsible for the knowledge and adherence to any and all laws, statutes, rules and
regulations pertaining to your use of our services. You agree that you will not (i) use
the services to commit a criminal offense or to encourage conduct that would
constitute a criminal offense or give rise to a civil liability, or otherwise violate any
local state, Federal or international law or regulation; (ii) upload or otherwise transmit
any content that you do not have a right to transmit under any law or contractual or
fiduciary duty; (iii) interfere or infringe with any trademark or proprietary rights of any
other party; (iv) interfere with the ability of other users to access or use our services;
(v) claim a relationship with or to speak for any individual, business, association,
institution or other organization for which you are not authorized to claim such a
relationship; (vi) interfere with or disrupt the service or servers or networks
connected to the service, or disobey any requirements, procedures, policies or
regulations of networks connected to the service; or (vii) reproduce, duplicate, copy,
use, distribute, sell, resell or otherwise exploit for any commercial purposes any
portion of the services.
Pathway International Privacy Policy

Introduction
Pathway International respects your privacy. Pathway International maintains this
Privacy Policy in order to demonstrate our firm commitment to your privacy and the
protection of your information. As part of our normal operations, we collect and, in
some instances, disclose information about you. To better protect your privacy, we
provide this notice explaining our information practices and the choices you can
make about the way your information is collected and used. Pathway International
reserves the right to make changes to this Privacy Policy at any time. You agree that
any changes will be effective when posted on-line at this location and that your
continued use of Pathway International's Services will constitute your acceptance of
any changes or additions to this Privacy Policy. The Privacy Program covers only
information that is collected through this Web site, and does not cover information
that may be collected through software downloaded from any of our sites. We will
not give any information about you to others without your express permission or as
provided within our agreement and this privacy policy.
Our site uses forms in which you give us contact information (your name, address,
telephone number, and email address) so you can place orders, request information
and support, and make product suggestions. We will then create an account for you
and if you choose to order from us using a credit card, we will collect your credit card
number and expiration date. If you contact us for support, we will keep an internal
record of what support was given. We use your customer information only when it
will be important for us to contact you regarding functionality changes to our
products, our web site, new Pathway International services, and special offers we
think you'll find valuable
In order to provide the services requested by you, our partners may require us to
share your personal information with them. We will only do so when it is necessary
and applies only to the services provided.

address) to help diagnose problems with our server, and to administer our Web site.

or the content of any other sites. All of our employees and contractors who have
access to, and are associated with the processing of your information, are obliged to

Updating Your Information
As a customer of Pathway International, you may alter your customer information by
sending us an email through our contact form on our website.
Sending Emails
We use emails to communicate with you, to confirm your placed orders, and to send
information that you have requested. We also provide email links, as on our "Contact
Us" page, to allow you to contact us directly. We strive to promptly reply to your
messages. The information you send to us may be stored and used to improve this
site and our products, or it may be reviewed and discarded.
Only If We Have To
As stated previously in this policy, we will not share your personal information except
with a third party to assist us in the processing or securing of your personal
information or when we are required by law or in good-faith belief that such action is
necessary in order to conform to the edicts of the law, or we must comply with a
legal process served on our web site. We may also need to give out your information
if one of our partners requires it, but these situations are rare.
Changes in Our Practices
If we make material changes to our information handling practices or other privacy
aspects, we will post those changes on this privacy statement. Any changes or
updates will be immediately effective upon reposting to this privacy policy on the
Pathway International Web site.
Service Provider
We may use a credit card processing company to bill users for goods and services.
These companies do not retain share, store or use personally identifiable information
for any secondary purposes.
Contest
From time-to-time our site requests information from users via surveys and contests.
Participation in these surveys or contests is completely voluntary and the user
therefore has a choice whether or not to disclose this information. Information
requested may include contact information (such as name and shipping address),
and demographic information (such as zip code, age level – you must be 18 or
above to enter). Contact information will be used to notify the winners and award
prizes. Survey information will be used for purposes of monitoring or improving the
use and satisfaction of our sites and services.
Tell-A-Friend
If a user elects to use our referral service for informing a friend about our site, we
ask them for the friend's name and email address. Pathway International will
automatically send the friend a one-time email inviting them to visit the site. Pathway
International stores this information for the sole purpose of sending this one-time
email. The friend may contact Pathway International at to request the removal of this
information from our database.
Termination of services and account
When Your Pathway International account is cancelled (either voluntarily or
involuntarily) all of your personally identifiable information is placed in "deactivated"
status on our relevant Pathway International databases. However, you should know
that deactivation of your account does not mean your personally identifiable
information has been deleted from our database entirely. We will retain and use your
personally identifiable information if necessary in order to resolve disputes or
enforce our agreements.
General
This Privacy Policy is incorporated into and subject to the Terms of Service that you
accept when ordering our Services. If you have any questions about this Privacy

Violations
If Pathway International determines in its sole discretion that your conduct violates
the terms of this Acceptable Use Policy, Pathway International may suspend, restrict,
terminate, or take any other appropriate action with regard to your services without
any obligation to refund fees paid. Pathway International reserves the right to take
such actions without notice to you. You understand that we reserve the right to
conclude that your conduct is in violation of the standards set forth in this Acceptable
Use Policy, and we may arrive at such a conclusion even if it is based upon our
opinion or mere suspicion or belief, without any duty to prove that our opinion or
suspicion is well founded, and even if (i) our opinion or suspicion is proven not to be
well founded or (ii) we provide other customers services that have similar
characteristics or are being used in a similar manner as your services. You agree
that we, in responding to a third party complaint, reserve the right in our sole
discretion to suspend or terminate the services subject to this Acceptable Use Policy
without notice and with no obligation to refund fees paid. You also understand and
agree that by providing you services, Pathway International in no way endorses your
Website or deems your content to be suitable under the terms of this Agreement.
You agree that Pathway International shall under no circumstances be held liable on
account of any action it takes, in good faith, to restrict transmission of material that it
or any user of the services considers to be fraudulent, obscene, lewd, lascivious,
filthy, excessively violent, harassing, or otherwise objectionable, whether or not such
material is constitutionally protected.
Modifications to this Acceptable Use Policy
You agree that Pathway International, in its sole discretion, may modify this
Acceptable Use Policy at any time. We will post any such revised policy on our
Website. You agree that any changes will be effective when posted on-line and that
your continued use of Pathway International's Services will constitute your
acceptance of any changes or additions to this AUP. Use of the Pathway
International services after the posting period constitutes acceptance of the
modification.

Pathway International Customer End User Agreement for Email Services

Pathway International Terms of Use for End-User of Email Services
This Agreement sets forth the general terms and conditions of your use of the
Pathway International Email Services ('Email Services'). Your use of Email Services
constitutes your agreement to all such terms and conditions. By using Email
Services, you acknowledge that you have read, understand and agree to be bound
by all the terms and conditions of this Agreement, along with any new, revised and
any additional terms and conditions used in conjunction with these terms, conditions
and policies including all Acceptable Use Policies (AUP) which Pathway International
may establish from time to time. Such Agreements, terms and Policies and updates
are found posted online at pathwayglobal.com/policies.htm. In addition, your
employer may have policies you must abide by in addition to those set by Pathway
International regarding your use of the Email Service. In no way shall those policies
set by your employer change or alter the policies set forth by Pathway International.
As our client, your employer is bound by terms and conditions that are in addition to
your terms and conditions. Those terms and conditions may affect your use of Email
Services. Depending on the specific account type purchased by your employer,
account space and CPU server bandwidth may be limited by a certain amount of
usage and storage space. You are responsible for ensuring that your email account
does not cause excessive overloading on Pathway International's DNS or server
network. In the event that you exceed your allotted bandwidth/data transfer and
thereby overload Pathway International’s DNS or servers, Pathway International
shall take any corrective action necessary to protect the network operation and
availability. Such corrective action may include but shall not be limited to account
suspension, relocation of account to a different DNS server, and deletion of existing
email stored on the servers. Your employer may be given the opportunity to upgrade
the account size. Pathway International will use its best efforts to e-mail Customers
who are at or near their bandwidth utilization limits, but Pathway International does
not take responsibility if email notification is not received by the Customer.
1. General Email Service Terms
Pathway International is providing you with the capability of sending and receiving
electronic mail via the Internet. You must: (a) provide all equipment, including a
computer and modem, necessary to establish a connection to the Internet; and (b)
provide for your own connection to the Internet and pay any telephone service fees
associated with such connection. Pathway International grants you a non-exclusive
license to use Email Services through our servers for the purpose of retrieving,
viewing, composing, and sending electronic mail and for other such electronic mail
purposes as are ordinary and customary. Pathway International Email Services are
accessible through your Internet Service Provider with your use of the third party
email client Microsoft Outlook Express or Outlook email programs. In addition, the
email service may work on other third party email clients such as Eudora. However
our setup procedure specifically applies to Outlook and Outlook Express. You are
free to use Email Services on any computer. You may setup the Email Services as
provided and allowed by the instructions. You may not otherwise alter or modify the
Software. You are not authorized to combine Email Services with any other software
program, nor are you authorized to integrate any plug-in or enhancement which uses
or relies upon Email Services. You are responsible for keeping copies of your email
that you wish to save on your computer and hard copy if you so desire for your
records. Pathway International regularly purges and deletes existing email stored on
our servers to free up account bandwidth/data space. Typically, any email purged
and deleted has been on our server for 30 days or more. Any such email purged and
deleted is unrecoverable.
Pathway International explicitly reserves the right to terminate your license if it
comes to Pathway International's attention that you are using Email Services for
objectionable activities, including sending unsolicited email or SPAM; activities
designed to defame, embarrass, harm, abuse, threaten, slander or harass third
parties; activities prohibited by the laws of the United States and/or foreign territories
in which you conduct business; activities designed to encourage unlawful behavior
by others, such as hate crimes, terrorism pornography and child pornography; or
activities that are tortuous, vulgar, obscene, invasive of the privacy of a third party,
racially, ethnically, or otherwise objectionable; activities designed to impersonate the
identity of a third party; activities designed to harm minors in any way. In addition,
your employer as our client has the authority to request that we terminate your
account for any reason at any time and we will do so.
2. Account Security
You agree to protect and treat as confidential your password and account
information. You are responsible for any and all activities that occur under your
account. You agree to notify Pathway International immediately of any unauthorized
use of your account or any other breach of security. You agree Pathway International
will not be liable for any loss that you may incur as a result of someone else using
your password or account, either with or without your knowledge. Pathway
International specifically disclaims liability for any activity in your account, whether
authorized by you or not.
3. Spam Policy
Pathway International does not tolerate the transmission of Spam. We monitor all
traffic (email) to and from our Web servers for indications of spamming. Customers
suspected to be using Pathway International products and services for the purpose
of sending Spam are fully investigated. If Pathway International determines that the
services in question are being used in association with Spam, Pathway International
will re-direct, suspend, or cancel any web site hosting, domain registration, email
boxes or other applicable services.
How We Define Spam
We define Spam as the sending of Unsolicited Commercial Email (UCE), Unsolicited
Bulk Email (UBE) or Unsolicited Facsimiles (Fax), which is email or facsimile sent to
recipients as an advertisement or otherwise, without first obtaining prior confirmed
consent to receive these communications from the sender. This can include, but is
not limited to, the following:
Email Messages
Newsgroup postings
Windows system messages
Pop-up messages (aka "adware" or "spyware" messages)
Instant messages (using AOL, MSN, Yahoo or other instant messenger programs)
Online chat room advertisements
Guest book or Website Forum postings
Facsimile Solicitations
4. What We Allow and Don't Allow
We will not allow our servers and services to be used for the purposes described
above. In order to use our products and services, you must not only abide by all
applicable laws and regulations, which include the Can-Spam Act of 2003 and the
Telephone Consumer Protection Act, but you must also abide by Pathway
International's no Spam policies and Acceptable Use Policies (AUP). Commercial
advertising and/or bulk emails or faxes may only be sent to recipients who have
already requested or "opted-in" to receive messages from the sender specifically.
They must include a legitimate return address and reply-to address, the sender's
physical address, and an opt-out method in the footer of the email or fax. Upon
request by Pathway International, conclusive proof of opt-in may be required for an
email address or fax number.
